Jaime Jackson Law recently helped settle a lawsuit on behalf of a young client against her insurance company. Our client had underinsured motorist’s (UIM) coverage in her insurance policy, but the insurance company denied paying the fair value of our client’s claim after our client was in a high-speed rear impact collision.
The collision occurred on northbound Interstate 95 as our client and a friend from college were on their way home for the Thanksgiving holiday. Our client’s vehicle was stopped for traffic when it was struck from behind by another car traveling at 51 miles per hour. The force of the collision pushed our client’s car into a car stopped in front. Our client’s car was totaled, and she was rendered unconscious by the collision. Our client suffered a traumatic brain injury. She also has significant and permanent post-concussive symptoms, neck and back pain, and resultant emotional injuries, including frustration, fright, shock, and anguish because of the crash.
Insufficient UIM coverage
The driver who struck our client had insufficient automobile liability insurance to compensate our client for her losses and damages from the crash, so our client turned to her own policy and the. underinsured motorist’s (UIM) coverage for her damages that exceeded the at fault party’s insurance coverage. However, the insurance company refused to pay our client the fair value of her damages. Underinsured Motorist (UIM) coverage is part of your auto insurance policy that protects you if you are in an accident caused by another driver who has insurance, but not enough to cover all of your damages.
After a period of discovery, including medical evaluations of our client and her ongoing medical issues, our client and her insurance company reached a settlement at mediation just before trial which will support her ongoing future medical needs.
