Our client, who was driving his car and wearing his seatbelt, suffered a severe thoracic spinal cord injury when his vehicle was rear ended. Rather than his seat protecting him and restraining his torso in place, he was propelled backwards into the rear seat of his car because the driver’s seatback had collapsed, and the head restraint became dislodged. In this case, the vehicle exited its travel lane and left the roadway for unknown reasons. The vehicle collided with a drainage ditch which caused it to flip over and catch fire. Tragically, the driver could not get out of the vehicle and died in the fire.
